General Terms and Conditions

1. Scope of application
These General Terms and Conditions apply to all contracts for services provided by RAD WANDER EVENT, owner Harald Kühn, Am Waldrand 6, 16816 Neuruppin.
RAD WANDER EVENT’s services are intended exclusively for business and institutional clients.
Contracts based on these General Terms and Conditions are not concluded with consumers within the meaning of Section 13 of the German Civil Code (BGB).
Individual agreements in the relevant offer take precedence over these General Terms and Conditions.
2. Enquiry, offer and conclusion of contract
An enquiry submitted via the website, by email, telephone or any other means is non-binding and does not yet constitute an order.
RAD WANDER EVENT will examine in particular the requested event location, the proposed date, the requested scope of services and the general feasibility of the event.
The client will then receive an individual written offer.
A contract is concluded when the client accepts the offer within the period of validity stated therein.
The type, scope, date, event location, service components and remuneration are primarily determined by the accepted offer.
3. Prices and payment
The agreed remuneration and the applicable payment deadlines are set out in the offer.
All prices are exclusive of the statutory value added tax payable in each case, insofar as value added tax applies.
The payment terms agreed in the relevant offer are decisive.
4. Cancellation by the client
A cancellation by the client must be made at least in text form, for example by email.
The date on which the cancellation notice is received by RAD WANDER EVENT is decisive for calculating the cancellation period.
In the event of cancellation, the following portions of the agreed total price become due:
- up to and including 29 calendar days before the event date: no cancellation fee, costs already incurred and no longer cancellable from third parties remain unaffected,
- from 28 to 15 calendar days before the event date: 30 % of the agreed total price,
- from 14 to 8 calendar days before the event date: 50 % of the agreed total price,
- from 7 to 5 calendar days before the event date: 80 % of the agreed total price,
- from 4 calendar days before the event date up to and including the event date: 100 % of the agreed total price.
The 100 % cancellation fee applicable from four calendar days before the event date takes into account, in particular, that by this time substantial preparatory work, route work, inspection rides or inspections on foot, travel and other work on site may already have begun or may have been completed in full.
The client is expressly permitted to prove that RAD WANDER EVENT suffered no loss or a substantially lower loss as a result of the cancellation.
Costs already incurred and no longer cancellable from third parties must be reimbursed in addition, insofar as they are not already covered by the applicable cancellation fee.
These include in particular costs for hotel accommodation, bindingly booked third-party services, event-related materials and other obligations entered into specifically for the event.
Hotel accommodation required for the preparation and conduct of an event will generally not be booked on a binding basis earlier than four weeks before the event date.
If non-cancellable bookings are made in this context, the costs actually incurred must be reimbursed by the client in the event of cancellation.
5. Weather, safety situation and force majeure
Safety takes priority at all events.
RAD WANDER EVENT is entitled to postpone an event if, due to external circumstances, conducting it on the agreed date would be unsafe or irresponsible.
This applies in particular in the event of:
- severe weather or official severe weather warnings,
- storms or a significant risk of storms,
- flooding,
- forest fires or an increased risk of forest fires,
- official closures,
- suddenly arising significant hazards on the planned route,
- other comparable circumstances for which RAD WANDER EVENT is not responsible.
In such a case, the event will not simply be cancelled without replacement.
RAD WANDER EVENT and the client will agree on a suitable alternative date.
A postponement necessary for safety reasons does not generally release the client from the obligation to pay the agreed total remuneration.
The remuneration already agreed will be credited towards conducting the event on the alternative date.
Mandatory statutory rights in the event of permanent impossibility of performance remain unaffected.
6. Changes to the route and event schedule
RAD WANDER EVENT events take place predominantly in public spaces and in the countryside.
Despite prior route checks, local conditions may change at short notice.
RAD WANDER EVENT may change the planned route, individual stations or the schedule if this is necessary for objective or safety-related reasons.
This applies in particular in the event of:
- construction sites,
- road or path closures,
- forestry work,
- weather-related damage,
- traffic obstructions,
- official measures,
- safety risks identified at short notice.
Where changes are necessary, RAD WANDER EVENT will endeavour to preserve the character, scope and experience of the agreed event as far as possible.
7. Inspection of cycling and hiking routes
New cycling and hiking routes planned for an event will be inspected on site before the event.
The inspection may be carried out by RAD WANDER EVENT itself or by persons commissioned by RAD WANDER EVENT.
A prior inspection cannot guarantee that roads, paths, traffic conditions, construction sites, natural conditions or other local circumstances will not change at short notice before the event date.
8. Responsibility of the client and participants
The client is responsible for informing its participants about the nature and basic requirements of the booked event.
Participants must be physically and medically capable of completing the relevant cycling or hiking route.
Each participant is obliged to assess their own abilities realistically and to follow RAD WANDER EVENT’s safety instructions.
At cycling events, the participants or the client are responsible for ensuring that the bicycles used are in a roadworthy condition.
All participants must comply with the applicable road traffic regulations and other statutory provisions.
Participants must behave in such a way that they do not endanger themselves, other participants or other road users.
9. Protection of route and event concepts
The content developed and compiled by RAD WANDER EVENT for an event is intended exclusively for the event booked in each case.
This includes in particular:
- individually compiled routes,
- station locations,
- hiding places and their positions,
- QR content,
- tasks and puzzles,
- hints and solutions,
- event schedules,
- event documents,
- other individually developed event elements.
Route knowledge and information about the specific event setup may not be passed on to third parties without the prior consent of RAD WANDER EVENT.
The client and participants may not adopt or reuse the event developed by RAD WANDER EVENT, or substantial parts thereof, for their own company, association, institutional or other event purposes.
In particular, without the prior consent of RAD WANDER EVENT, the content may not be copied, reproduced, recreated, used commercially or made available to third parties for conducting their own events.
This does not, of course, affect the general use of publicly accessible roads and paths.
10. Client’s obligations to cooperate
The client shall provide RAD WANDER EVENT in good time and in full with all information required for planning and conducting the event.
This includes in particular:
- desired event location,
- event date,
- expected number of participants,
- desired allocation between cycling and hiking groups,
- desired duration and other scope of services,
- specific requirements or requests of the client.
Any changes that may affect planning, preparation or conduct must be reported to RAD WANDER EVENT without delay.
11. Liability
RAD WANDER EVENT is liable without limitation for damage caused intentionally or through gross negligence.
Liability for damage arising from injury to life, limb or health remains unlimited.
In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the damage typical for the contract and foreseeable at the time the contract was concluded.
Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the client may regularly rely.
RAD WANDER EVENT is not liable for damage resulting exclusively from a participant’s failure to observe safety instructions, traffic rules or other binding requirements, insofar as RAD WANDER EVENT is not itself responsible for the damage.
Mandatory statutory liability provisions remain unaffected.
12. Final provisions
The law of the Federal Republic of Germany applies to the contractual relationship.
Individual agreements in the offer or other agreements expressly concluded between RAD WANDER EVENT and the client take precedence over these General Terms and Conditions.
If the client is a businessperson, a legal entity under public law or a special fund under public law, and an agreement on jurisdiction is legally permissible, Neuruppin is agreed as the place of jurisdiction.
